Patient data
Most AI vendors dodge the patient data question. I answer it in writing, before any work starts.
Before any patient information flows, a Business Associate Agreement is signed. No exceptions. Your counsel reviews it. That is the rule, not a handshake.
Patient data only goes into HIPAA-eligible tools with BAA coverage. Anything without coverage never sees it.
No patient information, prompts, or outputs are used to train or improve any model. I only use tools whose BAA covers your data.
Every clinical-adjacent output gets a human verification gate before it counts. Where identifiable data is not needed, I de-identify it and take the BAA question off the table entirely.
